EVENT TERMS AND CONDITIONS

1

ENTRY

1.1 By submitting your application and paying your fee you are agreeing to enter the TMF Group Island Walk (the Event) and also agree to abide by these Terms and Conditions and any instructions given to you by the organisers and officials of the Event.
1.2 Any entrant under the age of 16 years of age on the date of the Event must be accompanied by an adult (a person over the age of 18) at times whilst participating in the Event.
1.3 Included in your walk pack will be a barcoded checkpoint card to record your time at each checkpoint, this should be used in accordance with the instructions in the information pack.
1.4 Walk packs will be posted to Channel Island and UK residents during the 1st week of June. All international entrants will need to collect their packs upon arrival in Jersey and shall be notified of collection points in due course.

CHANGE OF ADDRESS

2.1 If your address details change after you have submitted your application, you can login at your own myracenation profile and change your postal address.
2.2 Approximately 2 weeks before the Event, walker packs (Channel Island & UK residents only) will be sent to the address held at that point. International entrants will need to collect their packs upon arrival in Jersey and shall be notified of collection points in due course. If you have any queries regarding this please email details of your old and new addresses and date of birth to islandwalkjersey@gmail.com.
2.3 We take no responsibility for items lost or misplaced in the post or, if you fail to comply with condition 2.1, for items despatched to the wrong address.

EVENT SAFETY

3.1 At all times during the Event you must adhere to all instructions given by the Event officials.
3.2 It is your responsibility to ensure that you have the correct equipment, footwear and clothing for the Event, taking the weather conditions into account.
3.3 Your participation in the Event is personal to you, you are strictly prohibited from swapping, selling or transferring your place in the Event or allowing any other person to wear your Event number and participate in your place. If you are no longer able to participate in the Event, please notify us since we may be able to register a substitute in your place.
3.4 All Event participants must present their checkpoint card at each checkpoint, so that we can track your progress. If you feel unable to finish the Event, you must notify a checkpoint marshal and hand over your checkpoint card.
3.5 Resources of the event organisers, including medical and safety services, along with event supplies for drink stations and checkpoint tents, are reserved solely for registered entrants.
3.6 You warrant to us that you are, and will be on the date of the Event, sufficiently fit and healthy to participate in the Event unaided. If you are in any doubt we recommend that you seek medical advice.

EVENT EJECTION

4.1 We reserve the right to refuse entry to the Event or ask you to cease participation if:
  1. you fail to follow instructions given by Event officials;
  2. you attempt to participate in the Event in a manner that we reasonably believe:
    1. may cause injury to you;
    2. may cause injury to another participant;
  3. may damage or harm the environment;
  4. is likely to cause offence; or
  5. otherwise causes a risk or potential risk to health and safety including any failure, in whole or in part, to comply with the restrictions in Condition 3 above (Event Safety):
  • in our opinion you are unfit to participate in the Event due to the consumption of alcohol, the use of drugs, an injury or illness; or
  • you fail to arrive at the start location at the specified time; or
  • you are unable to make sufficient progress in the Event to allow you to complete the event in line with timelines set by Event officials, as identified in the checkpoint operating hours: See FAQs.

CANCELLATION BY YOU

5.1 You should inform us immediately, in writing, to islandwalkjersey@gmail.com if you incur an injury or develop a medical condition which prevents you from participating in the Event and need to withdraw. As a charity, we cannot offer refunds because 100% of your Fee goes towards the charitable funds, which will be distributed to the local causes and charities supported each year. We shall, where possible, transfer your entry to another person nominated by you to participate in your place.
5.2 Entries are non-transferable either to a different participant or to subsequent Around the Island Walk events in future years.

CANCELLATION BY US

6.1 We may cancel the Event if circumstances beyond our reasonable control arise, including, without limitation, inclement weather conditions, or other events that may make it impossible to operate the Event.
6.2 In such circumstances:
  1. we will endeavour to stage the Event at a later date. Any changes to the Event will be communicated to you at the Event or sooner if practicable;
  2. you will have the right to take part in the re-staged Event; and
  3. if you are unable to take part in the re-staged Event, you will receive a refund of the fees.
6.3 In the event of cancellation of the Event we will have no responsibility for any costs incurred as a result of cancellation including any travel or accommodation costs, including your travel to the Event location.

DATA PROTECTION

7.1 You agree that your personal information can be stored, used by us and our Event partners in connection with the organisation, staging and administration of the Event.
7.2 You agree that your personal information may be anonymised and the anonymised data may be used by us and our Event partners in connection with the compilation of statistical information and to improve health and safety procedures at future Events.
7.3 You agree that your name, image and contact details can be used by us and our Event partners for the purposes of:
  1. the promotion and marketing of the Event;
  2. adding you to a mailing list to keep you informed about any future Events.
7.4 We shall take all necessary steps to ensure that personal information pertaining or relating to you which comes into our possession or control or our Event partners shall not be:
  1. used or reproduced in whole or in part in any form except for the purposes outlined in these Conditions;
  2. disclosed to any person not authorised by you to receive it; or
  3. altered, deleted, added to or otherwise interfered with (except where expressly permitted by these Conditions).
7.5 If you would not like us or our Event partners to use personal information other than for purposes related solely to your participation in the Event, please email us at islandwalkjersey@gmail.com.
7.6 By agreeing to the terms and conditions you will receive a number of information emails which will include training information and latest updates on the Event itself.

CHANGES TO THE EVENT

8.1 We reserve the right to reduce the course distance, change the course, or make any other amendment to the Event that we deem necessary to stage the Event. Any change to the Event will be communicated to you at the Event or sooner if practicable.
8.2 Should the course distance be reduced as per clause 8.1 above for the avoidance of doubt you agree that the Event is still deemed to be staged and that we will not be liable to you for any refund.

USE OF IMAGE

9.1 The Event may be televised and photographs may be taken which capture your participation in the Event. You agree to the publication of photographs and broadcasts of your image which accurately depict your participation in the Event.

MEDICAL CONDITIONS

10.1 It is strongly recommended that you train for the Event and prepare for the challenge. If you have not exercised before or for some time, you should consult your doctor before commencing your training for the Event.
10.2 You must complete all the required medical information fields at the time of registration prior to participating in the Event. Medical information will only be used to allow medical assistance to be given on the Event date.

LIABILITY

11.1 In no event shall we be liable to you, whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Agreement for any:
  1. loss or damage;
  2. loss of profit;
  3. loss of reputation;
  4. loss of business, revenue or goodwill;
  5. loss of anticipated savings;
  6. pledges made on your behalf or by you to charity; or
  7. consequential or indirect loss, regardless of whether the loss or damage would arise in the ordinary course of events, is reasonably foreseeable; or is in the contemplation of the parties, or otherwise.
11.2 Nothing in this Agreement shall affect our liability for death or personal injury, fraud, or any other liability to the extent it cannot be excluded or limited by law.
11.3 We shall procure and maintain appropriate third party liability insurance for the Event for our own benefit. You:
  1. acknowledge that you are not entitled to benefit under such insurance where any claim is made against you by a third party for death, personal injury or damage to property arising out of or in connection with your negligent actions or omissions whilst participating in the Event; and
  2. shall indemnify us and keep us indemnified against any claim made against us by a third party for death, personal injury or damage to property arising out of or in connection with your negligent actions or omissions whilst participating in the Event.

REFUND POLICY

12.1 Once we have confirmed your participation in the Event we will not provide any refund if you choose to cancel the Agreement other than in accordance with Condition 5.

13

GENERAL

13.1 The Agreement shall be governed by the laws of the Island of Jersey, and the parties submit to the exclusive jurisdiction of the courts of the Island of Jersey.
13.2 If any provision of the Agreement is invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.
13.3 The Agreement does not create, confer or purport to confer any benefit or right enforceable by any person not party to it.



ISLAND WALK EVENT SPECIFIC CONDITIONS

ENTRY POLICY

1.1 By submitting your application and paying your fee you are agreeing to enter the Event and also agree to abide by these Event Terms and Conditions, these Event Specific Conditions and any instructions given to you by the organisers and officials of the Event.
1.2 To participate in the Event, you must be at least 16 years of age on Saturday 20 June 2020.
1.3 Your entry is individual to you and you may not transfer your entry to a different participant or to a different Event.

2.2 If your entry is accepted the fee is non-refundable other than as otherwise stated in the Agreement.

LOST OR MISSING EVENT NUMBERS

3.1 If you have not received your information pack one week before the Event date you should email us at the following address to islandwalkjersey@gmail.com.
3.2 All enquiries relating to the non-arrival of walker packs or lost walker packs that we are unable to resolve prior to the Event date will be handled at the Event. We will not be able to consider an enquiry unless you are able to provide appropriate photographic ID.



WEBSITE TERMS & CONDITIONS

1 By using the Website, you signify your acceptance of these terms and conditions in consideration of which we provide you with access. From time to time we may modify these terms and conditions so please continue to review them whenever accessing or using the Website. If at any time you do not wish to accept the Terms, you may not use the Website. From time to time we may run competitions and promotions via the Website. Separate terms and conditions will be posted where applicable governing such competitions and promotions.

10 You agree by using the online registration process that your participation in the TMF Group Island Walk is entirely at your own risk. Whilst the Around the Island Walk Trust endeavours to make the Event as safe as possible anyone participating in this Event accepts that they do so at their own risk. Neither the Around the Island Walk Trust nor the owners of any property or land on or adjacent to the walk takes any responsibility for any loss of or damage to any property or injury to or death of any person whether caused by a negligent act, omission or wilful misconduct.
11 These terms are governed by the laws of Jersey and the parties submit to the exclusive jurisdiction of the Jersey courts.

What information do we collect?

The types of information we collect might include your name and address details, date of birth, e-mail address, telephone number, fax number and the contact details of someone we can call for you incase of an emergency during the walk. We will obtain personal information from you when you register with us.

We will use your personal information to provide you with the services, products or information you have requested, for administration purposes, to improve the services we provide and to further our charitable aims. Your information will not be shared with any third parties.

A ‘Cookie’ is a small piece of information sent from our Website to your computer and stored on your hard drive to help us to identify you quickly when you next visit. A “Cookie” allows us to personalise the Website to your requirements and avoid lengthy registration/personalisation.

All online registration payments are processed securely by our agent, Race Nation. We take appropriate measures to ensure that the information disclosed to us is kept secure, accurate and up to date and kept only for so long as is necessary for the purposes for which it is used.
